January 2025 Proposed Waiver Amendments for Public Comment

The Office of Developmental Programs (ODP) is pleased to announce the opportunity for public comment on proposed changes to implement performance-based contracting for residential services in the Consolidated and Community Living Waivers as well as proposed changes to the Consolidated, Community Living, Person/Family Directed Support (P/FDS), and Adult Autism Waivers that are not related to performance-based contracting. All proposed changes are scheduled to take effect January 1, 2025.  ODP is seeking your valuable feedback and comments on performance-based contracting and other proposed waiver amendments.  The proposed changes are available for public comment from April 20, 2024 to June 4, 2024.

Public Comment Webinar Opportunities:

ODP is hosting a series of public comment webinars to provide an overview of how it proposes to implement Performance-Based Contracting for Residential Services effective January 1, 2025. Additional proposed changes to the Consolidated, Community Living, P/FDS, and Adult Autism Waivers that are not related to Performance-Based Contracting will also be covered. Registered participants will have the opportunity to provide verbal comments during the session.

May 2024 Waiver Amendments Submitted to the Centers for Medicare and Medicaid Services (CMS)

The Office of Developmental Programs (ODP) is pleased to announce that amendments to the Consolidated, Community Living, Person/Family Directed Support (P/FDS), and Adult Autism Waivers   were submitted to CMS on March 14, 2024. The waiver amendments will make one-time workforce recovery supplemental payments available for providers.  Modifications were made as a result of public comments received from 39 individuals and self-advocates, families, agencies, and organizations.  The waiver amendments also include increases to the unduplicated number of participants served in the Consolidated and Community Living Waivers for Waiver Year 2 (calendar year 2024) and subsequent years.

CMS has 90 days to review the waivers and additional changes may occur based upon discussion with CMS during the approval process. It is anticipated that the waiver renewals will be approved and effective May 1, 2024. ODP will inform all stakeholders when CMS has officially approved the waivers and will make the approved waivers available at that time.
