ODP Announcement 20-097: Appendix K Second Submission and Approval — Emergency Preparedness and Response for ODP Waivers

Purpose

To announce the approval of the second submission of Appendix K for the Consolidated, Community Living, Person/Family Directed Support (P/FDS), and Adult Autism Waivers.


Discussion

In March of 2020 and in response to the COVID-19 pandemic, the Office of Developmental Programs (ODP) received approval from the Centers for Medicare and Medicaid Services (CMS) to make temporary changes to the approved Consolidated, Community Living, P/FDS, and Adult Autism Waivers through an Appendix K amendment. On March 23, 2020, ODP released Announcement 20-027 that included the changes that were made to the Waivers as well as operational guidance.

On July 23, 2020, ODP received approval from CMS for a second Appendix K to further amend the Waivers during the emergency. The changes outlined in the second Appendix K are in addition to the changes that were made in the first Appendix K. All changes, unless otherwise noted, are effective beginning March 11, 2020. While many of the changes made in the second Appendix K have already been communicated to stakeholders and implemented, ODP is working on updated guidance that reflects current policy.
